The wage rates that were effective in 2010 remain in effect because an appeal has been filed challenging the rates set for 2011. The effectiveness of the new rates is stayed pending resolution of the appeal before the Labor and Industrial Commission.

Attention: Contractors and all contracting tiers on a project must fill out:
The Statement of Intent to Pay Prevailing Wages
- The Statement of Intent to Pay Prevailing Wages must be filed with the Contracting Agency
within three (3) business days of the award of contract.
- Send the form to the Department of Workforce Solutions (DWS) for approval.
- DWS will approve it and fax it to the General Contractor.
- General Contractor Information must be filled in.

Affidavit of Wages Paid
- The Affidavit of Wages Paid must be filed prior to the final payment to a contractor.
- Send the form to the Department of Workforce Solutions (DWS) for approval.
- DWS will approve it and fax it to the General Contractor.
- General Contractor Information must be filled in.

Wage Decision Information
Who needs to fill out this form?
Engineering Firms, Architect Firms and Contracting Agencies.
Please allow us five work days to issue a wage decision. Bid openings do not take place until ten days after advertising appears in newspapers. On complex projects usually 30 to 45 days occur between advertising and bid opening.
Wage Decision request must be made at least 3 weeks prior to advertising date!

UPDATED NOTICE:
Pursuant to Governor Susana Martinez’s dismissal of the NM Labor Commission (press release dated 1-14-11), the 2010 wage rates will remain in effect until further notice. These wage rates can be accessed through our website at http://www.dws.state.nm.us/dws-pubwage.html.

NOTICE OF PUBLIC HEARINGS
The New Mexico Department of Workforce Solutions – Labor Relations Division will hold two public hearings in regard to prevailing wages on public works construction projects.
The first public hearing will be held on November 23, 2009 at 625 Silver Avenue SW, Albuquerque, New Mexico in the 1st Floor Conference Room at 9:00am. This public hearing has been set to consider proposed changes to the New Mexico Administrative Code (NMAC) 11.1.2.11 – 11.1.2.13. Specifically, these proposed regulation changes have been made to comply with statutory changes made pursuant to Senate Bill 33 which was passed during the 2009 regular session of the legislature. This legislation has altered the way that prevailing wages for public works projects will be set, from a survey style method to utilizing collective bargaining agreements and other relevant data to set the rate. This public hearing will consider the proposed wages for prevailing wage projects for 2010. The wages were established pursuant to the annual wage survey. A copy of the wages or the lists of participating contractors may be obtained from Nicolina Rushalko at 841-4403.
